Article 1. Applicability

1.1 All offers, orders and agreements of VINOS QUIXOTE are subject to the exclusion of any other general terms and conditions of sale (hereinafter: Terms and conditions).  These conditions have been filed with the Dordrecht Chamber of Commerce under number 17199630 and will be sent by us on request.
1.2 All rights and claims, as stipulated in these terms and in any further agreements for VINOS QUIXOTE, are equally stipulated for intermediaries and other parties engaged by VINOS QUIXOTE.
1.3 derogations from the conditions may be made in writing only, in which case the other provisions remain in full force.
1.4 making an order implies that you unconditionally accept the applicability of these terms and conditions.

Article 2. Agreement and offers
2.1 All offers made by VINOS QUIXOTE are without obligation and VINOS QUIXOTE expressly reserves the right to change prices, in particular where this is necessary under (legal) regulations, or in the case of publication and/or printing errors.
2.2 an agreement is only made after your order has been accepted by VINOS QUIXOTE.  VINOS QUIXOTE is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly provided otherwise. Vinos Quixote will not handle orders placed by persons under the age of 18 (18).

Article 3. Delivery
3.1 the delivery times given by VINOS QUIXOTE are indicative only. Exceeding any delivery period does not entitle you to compensation or to cancel your order or to dissolve the agreement, unless the delivery period is such that you cannot reasonably be required to maintain the agreement.  In that case, you are entitled to cancel the order or dissolve the agreement as necessary.
3.2 the minimum order size for standard sizes is 6 wine bottles. There is a contribution to the delivery costs of €9.95 per address per box, from 2 boxes this is €13.10 and for purchases from €50,- delivery is free. For orders in different (gift) packaging, different delivery costs to be determined BY VINOS QUIXOTE apply.

Article 4. Rates and payments
4.1 the prices quoted for the products and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other charges, unless otherwise stated or agreed in writing.
4.2 Payment can only be made through the use of the IDEAL.

Article 5. Retention of title
5.1 the ownership of the delivered products will not pass until you have fulfilled all that you owe VINOS QUIXOTE under any agreement.  The risk of the products is already transmitted to you at the time of shipment.

Article 6. Complaints and Liability
6.1 YOU have the obligation to check on delivery whether the products comply with the agreement.  If this is not the case, you must INFORM VINOS QUIXOTE in writing as soon as possible and in any case within five working days of delivery.  If it has been shown that the products do not comply with the agreement, VINOS QUIXOTE has the choice to replace the products concerned with new products or to refund the invoice value thereof.

Article 7. Orders/communication
7.1 for mutilations, delays or improper delivery of orders and communications resulting from the use of the Internet or any other means of communication in traffic between you and VINOS QUIXOTE, or between VINOS QUIXOTE and third parties, As far as the relationship between you and VINOS QUIXOTE is concerned, VINOS QUIXOTE is not liable, unless and to the extent that there is intent or gross negligence on the part of VINOS QUIXOTE.

Article 8. Force Majeure
8.1 without prejudice to the other rights to which it is entitled, in case of force majeure, VINOS QUIXOTE has the right, at its own discretion, to suspend the execution of your order or to dissolve the agreement without judicial intervention, without VINOS QUIXOTE being obliged to pay any damages, unless this would be unacceptable in the given circumstances according to criteria of reasonableness and fairness.

Article 9. Miscellaneous
9.1 If you write to VINOS QUIXOTE about an address, VINOS QUIXOTE is entitled to send all orders to that address, unless you write to VINOS QUIXOTE about another address to which your orders must be sent.
9.2 If, for a short or longer period, VINOS QUIXOTE permits or does not tacitly grant derogations from these terms, this does not affect its right to demand immediate and strict compliance with these terms.  You can never assert any rights on the grounds that VINOS QUIXOTE applies these conditions smoothly.
9.3 VINOS QUIXOTE is authorized to use third parties in the execution of your order(s).
9.4 VINOS QUIXOTE reserves the right to change these terms and conditions at any time.

Article 10. Applicable law and competent court
10.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these terms, are governed exclusively by Dutch law.
10.2 All disputes between the parties shall be exclusively submitted to the competent court in the Netherlands.
